By accessing and using Energy Enterprise Platform ("the Platform"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to these Terms of Service, please do not use the Platform.

2. Description of Service

Energy Enterprise Platform provides a comprehensive software platform for renewable energy project lifecycle management, including but not limited to:

• Design and engineering tools for PV systems, BESS, and microgrids
• Real-time SCADA and power plant control systems
• Energy trading and optimization software
• Asset management and maintenance tracking
• Analytics and performance optimization tools
• Equipment marketplace and procurement platform

3. User Accounts

To access certain features of the Platform, you must register for an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Maintain the security of your password and account
• Notify us immediately of any unauthorized use of your account
• Accept responsibility for all activities that occur under your account

4. Subscription and Payment

Certain features of the Platform require a paid subscription. By subscribing, you agree to:

• Pay all fees associated with your chosen subscription plan
• Provide valid payment information and authorize recurring charges
• Subscription fees are billed in advance on a monthly or annual basis
• Refunds are provided only as required by applicable law
• We reserve the right to change subscription fees with 30 days notice

5. Acceptable Use Policy

You agree not to use the Platform to:

• Violate any applicable laws or regulations
• Infringe on intellectual property rights of others
• Upload malicious code, viruses, or harmful content
• Attempt to gain unauthorized access to the Platform or other users' accounts
• Interfere with or disrupt the Platform's operation
• Use the Platform for any illegal or unauthorized purpose
• Reverse engineer, decompile, or disassemble any part of the Platform

6. Intellectual Property

The Platform and its original content, features, and functionality are owned by Energy Enterprise Platform and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. You retain ownership of any data you upload to the Platform, but grant us a license to use, store, and process that data to provide the service.

7. Data and Privacy

Your use of the Platform is also governed by our Privacy Policy. We collect, use, and protect your data as described in the Privacy Policy. By using the Platform, you consent to our collection and use of your data in accordance with the Privacy Policy.

8. Limitation of Liability

To the maximum extent permitted by law, Energy Enterprise Platform shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of the Platform.

9. Warranty Disclaimer

The Platform is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Platform will be uninterrupted, secure, or error-free.

10. Termination

We reserve the right to suspend or terminate your account and access to the Platform at our sole discretion, without notice, for conduct that we believe violates these Terms of Service or is harmful to other users, us, or third parties, or for any other reason.

11. Changes to Terms

We reserve the right to modify these Terms of Service at any time. We will notify users of any material changes via email or through the Platform. Your continued use of the Platform after such modifications constitutes your acceptance of the updated terms.

12. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions. Any disputes arising from these terms shall be resolved in the courts located in San Francisco County, California.
